Terms & Conditions

These terms govern your access to and use of the SportSphere platform, including bookings, payments, and venue management. Please read them carefully before using the Platform.

Section 01

Definitions

  • Platform — the SportSphere mobile application, web application, and related services.
  • User — any person who registers on the Platform, including Players and Turf Staff.
  • Player — a User who searches for and books turf slots.
  • Venue / Turf Partner — a sports facility (and the company/owner operating it) listed on the Platform.
  • Turf Staff — caretakers, managers, and owners operating a Venue through the Platform.
  • Booking — a reservation of a turf slot made through the Platform.
  • We / Us / SportSphere — the operator of the Platform, registered at A-28/401 Abhishek CHS, Charkop Sector 4, Kandivali (W), Mumbai – 400067.
Section 02

Nature of the Service — Marketplace / Intermediary

SportSphere is a technology platform that connects Players with independent Turf Partners. We do not own, operate, or control the venues. The contract for the use of a turf is between the Player and the Turf Partner. We act as an intermediary within the meaning of the Information Technology Act, 2000.

Venue information (photos, amenities, pricing, availability) is provided by Turf Partners. While we require accuracy, we do not independently verify all listings and are not liable for errors in Partner-provided content.

Turf Partners are responsible for the condition, safety, legality, licensing, and maintenance of their venues and for honouring confirmed Bookings.

Section 03

Eligibility and Accounts

  • You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872. Minors aged 13–17 may use the Platform only under the supervision of a parent or legal guardian who accepts these Terms on their behalf.
  • Registration requires a valid Indian mobile number, verified by one-time password (OTP). You are responsible for maintaining the confidentiality of your device and OTPs. All activity under your account is deemed to be yours.
  • You agree to provide accurate, current, and complete information and to keep it updated. One person may hold only one account per role unless we approve otherwise.
  • Turf Staff accounts (caretaker/manager) require a valid invite code issued by the relevant Venue's owner. Owners are responsible for the actions of the staff they invite.
  • We may refuse, suspend, or terminate accounts at our discretion for breach of these Terms, suspected fraud, or unlawful activity.
Section 04

Bookings and Slot Locking

  • Slot availability shown in the App is real-time but not guaranteed until a Booking is confirmed.
  • When you begin checkout, the selected slot is temporarily locked for a limited time to prevent double-booking. If payment is not completed within the lock window, the lock expires automatically and the slot is released to other users. Repeatedly locking slots without completing payment may result in account restriction.
  • A Booking is confirmed only when (a) payment is successfully completed via the payment gateway, or (b) for pay-later / manual-UPI / offline bookings, when the Venue's manager verifies and confirms the payment or booking. Until then, a "pending" status does not guarantee the slot.
  • Bookings may span midnight (overnight slots) and are governed by the times shown at checkout in Indian Standard Time (IST).
  • Bookings created on your behalf by Venue staff (e.g., walk-in or phone bookings recorded by a caretaker/manager) are also subject to these Terms.
  • You must arrive on time. Late arrival does not extend your slot. Usage rules at the venue (footwear, conduct, equipment, capacity) are set by the Turf Partner and must be followed.
Section 05

Pricing, Negotiation, and Coupons

  • Prices are set by Turf Partners and may vary by day, time, partition (half/full ground), sport, and demand. The final price, including any taxes, fees, or discounts, is shown at checkout.
  • The in-app chat may allow price negotiation. A negotiated price is valid only if reflected in a formal negotiation offer accepted within the App before its expiry, and only for the specific slot(s) offered. Expired negotiations are void.
  • Coupons/discounts are subject to their stated conditions, may be withdrawn at any time, have no cash value, and may not be combined unless stated.
  • Obvious pricing errors (e.g., misconfigured amounts) may be corrected, and affected unconsummated bookings cancelled with a full refund.
Section 06

Payments

  • Online payments are processed by Cashfree Payments India Pvt. Ltd., an RBI-regulated payment aggregator. By paying, you also agree to Cashfree's terms. We do not store your card number, CVV, or UPI PIN.
  • Manual UPI payments: some Venues accept direct UPI payment to the Venue's UPI ID. For such payments you must submit the correct transaction reference (UTR) and/or payment screenshot in the App. The Booking is confirmed only after the Venue verifies receipt. Submitting forged or manipulated payment proofs is fraud and will result in permanent ban and may be reported to law enforcement.
  • Payment verification timeouts: if a payment is not verified within the time window shown in the App, the Booking may be cancelled and the slot released.
  • You authorise us and the Venue to send you transactional communications (SMS/push/notifications) regarding your payments and bookings.
  • All amounts are in Indian Rupees (INR). You are responsible for any bank or UPI app charges levied by your provider.
Section 07

Cancellations, Rescheduling, and Refunds

Cancellation by Player:

  • More than 24 hours before slot start: full refund (minus payment gateway charges, if any).
  • 6–24 hours before slot start: 50% refund.
  • Less than 6 hours before slot start / no-show: no refund.

Venues may publish their own stricter or more lenient policy on their listing; the policy shown at the time of booking prevails.

Cancellation by Venue: if a Venue cancels a confirmed Booking (e.g., maintenance, weather, double-booking error), you will receive a full refund of the amount paid, or, at your option, a free reschedule.

Weather: outdoor turf bookings affected by severe weather are governed by the Venue's weather policy; unless the Venue closes the facility, weather alone does not entitle you to a refund.

Refund processing: approved refunds to online payment methods are initiated within 7 business days and credited per your bank's timelines (typically 5–7 business days). Manual-UPI refunds are paid by the Venue directly; we will assist in facilitating them.

Disputes: raise booking or payment disputes through the in-app Support/Dispute section or support@mysportsphere.com within 7 days of the slot date. We will review evidence from both sides (booking records, payment records, chat logs) and communicate an outcome within 15 days. Our determination on Platform-level disputes is final, without prejudice to your statutory rights under the Consumer Protection Act, 2019.

Section 08

User Conduct

You agree not to:

  • provide false identity or payment information, or submit fake payment proofs/UTRs;
  • make bookings with no intention to honour them, or systematically lock slots to deny availability to others;
  • harass, abuse, or threaten Venue staff or other users in chat or reviews; post obscene, defamatory, hateful, or unlawful content;
  • post fake, incentivised, or malicious reviews;
  • circumvent the Platform to avoid fees after being connected to a Venue through the Platform, where a platform fee applies;
  • reverse engineer, scrape, copy, or interfere with the Platform, or attempt to access other users' data or admin functions;
  • use the Platform for any unlawful purpose, including gambling or betting on matches;
  • impersonate any person or misrepresent affiliation with a Venue;
  • upload viruses, malware, or content that infringes third-party rights.

Violation may result in booking cancellation without refund, account suspension or termination, forfeiture of amounts due, and legal action.

Section 09

User Content (Reviews, Photos, Chat)

  • You retain ownership of content you post (reviews, photos, messages) but grant SportSphere a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and distribute it on the Platform for operating and promoting the service.
  • You are solely responsible for your content. We may (but are not obliged to) moderate, edit, or remove content that violates these Terms or applicable law, including under the IT Rules, 2021.
  • Reviews must reflect genuine experiences. Venues may not review themselves or offer incentives for reviews.
Section 10

Terms Specific to Turf Partners (Owners, Managers, Caretakers)

  • Listing accuracy: Owners warrant that they have the legal right to operate and list their venue, that all licences/permits required to run a sports facility are held and current, and that listing content (photos, amenities, prices) is accurate and not misleading.
  • Honouring bookings: confirmed Bookings must be honoured. Repeated cancellations may result in delisting.
  • Staff: Owners are responsible for staff invited via invite codes and must promptly revoke access for departing staff. Configuration changes to turfs are audit-logged.
  • Payments & settlement: where payments are collected via the Platform's gateway, settlements follow the agreed settlement cycle, minus applicable platform commission/fees. Where Players pay the Venue's UPI directly, the Venue bears responsibility for reconciliation and for refunds owed under the Cancellations, Rescheduling, and Refunds section.
  • Subscription: access to manager/owner tooling may require a paid subscription tier. Fees are non-refundable except where required by law. We may change subscription pricing with 30 days' notice.
  • Taxes: Turf Partners are solely responsible for their own GST registration, invoicing to customers where applicable, income tax, and local levies on venue services.
  • Customer data: Player data visible to Turf Staff (names, phone numbers, bookings, chats) may be used only to fulfil bookings and provide the venue service — not for marketing spam, resale, or any other purpose. Breach is grounds for immediate termination and liability under the DPDP Act, 2023.
  • Insurance & safety: Venues must maintain the facility in safe condition and are encouraged to hold public liability insurance. Venues are solely liable for injuries or losses occurring at their premises, except to the extent caused by SportSphere's own negligence.
Section 11

Assumption of Risk (Sports Activity)

Participation in sports involves inherent risk of injury. You participate at your own risk and are responsible for ensuring you are medically fit to play. To the maximum extent permitted by law, SportSphere is not liable for personal injury, death, or property damage/loss (including theft) occurring at a Venue. Claims relating to venue conditions should be directed to the Turf Partner.

Section 12

Intellectual Property

The Platform, including its software, design, logos, and the "SportSphere" name, is owned by or licensed to us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the App for personal/venue-management use in accordance with these Terms. No other rights are granted.

Section 13

Availability, Changes, and Beta Features

  • The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation; outages, maintenance, or third-party failures (Firebase, Cashfree, telecom/SMS delivery) may affect availability, including OTP delivery.
  • We may add, modify, or discontinue features at any time. We may impose usage limits.
  • Notifications depend on your device settings and third-party services; do not rely solely on push notifications for time-critical information.
Section 14

Disclaimers and Limitation of Liability

  • To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • To the maximum extent permitted by law, SportSphere's aggregate liability for any claim arising out of or relating to the Platform shall not exceed the greater of (a) the amount you paid through the Platform for the Booking giving rise to the claim, or (b) INR 5,000.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
  • Nothing in these Terms limits liability that cannot be limited under Indian law, including liability for fraud or for rights you hold as a consumer under the Consumer Protection Act, 2019.
Section 15

Indemnity

You agree to indemnify and hold harmless SportSphere, its directors, employees, and agents from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your content, (c) your violation of law or third-party rights, or (d) for Turf Partners, the operation of your venue.

Section 16

Suspension and Termination

  • You may stop using the Platform at any time and may request account deletion per the Privacy Policy.
  • We may suspend or terminate your access immediately for breach, fraud, chargebacks, abusive conduct, or legal requirement. Upon termination for cause, pending bookings may be cancelled; amounts lawfully refundable will be refunded.
  • Sections that by nature survive termination (IP, indemnity, limitation of liability, disputes, governing law) survive.
Section 17

Communications

You consent to receive transactional communications (OTP SMS, push notifications, email) related to your account and bookings. Marketing communications, if any, will include an opt-out. Transactional messages cannot be opted out of while your account is active.

Section 18

Governing Law and Dispute Resolution

  • These Terms are governed by the laws of India.
  • Courts at Mumbai, Maharashtra shall have exclusive jurisdiction, subject to the point below.
  • Nothing herein deprives you of remedies before consumer fora under the Consumer Protection Act, 2019, including e-commerce grievance mechanisms under the Consumer Protection (E-Commerce) Rules, 2020.
  • Before initiating proceedings, the parties agree to attempt good-faith resolution via the Grievance Officer for 30 days.
Section 19

Grievance Officer / Nodal Contact

Acknowledgement within 48 hours; resolution within 15 days (per the Consumer Protection (E-Commerce) Rules, 2020 and the IT Rules, 2021).

Section 20

General

  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Platform.
  • Severability: if any provision is held invalid, the remainder stays in effect.
  • No waiver: failure to enforce a provision is not a waiver.
  • Assignment: you may not assign these Terms; we may assign to an affiliate or successor.
  • Changes: we may revise these Terms; material changes will be notified in-app at least 7 days before taking effect. Continued use constitutes acceptance.
  • Force majeure: neither party is liable for delay/failure caused by events beyond reasonable control (natural disasters, war, epidemics, government action, internet/telecom failure).
  • App stores: your use of the App is also subject to the Google Play and Apple App Store terms. Apple/Google are not parties to these Terms and have no obligation to provide support for the App.
